Local Ordinances now require a 24-hour local Responsible Party to be available to be onsite at short-term rental properties within one hour of being summonded by government officials or to address safety or other issues with guests.
SHORT-TERM RENTAL RESPONSIBLE PARTY AGREEMENT
The following agreement hereby includes all of the details and responsibilities between the undersigned parties for designation of STREAM ADVISORS, LLC, (COMPANY ADDRESS) and its agents (herein after RESPONSIBLE PARTY) by (OWNER NAME & ADDRESS) (herein after OWNER) at the SHORT-TERM RENTAL RESPONSIBLE PARTY for the property located at (PROPERTY ADDRESS)
This designation shall be valid for the period beginning February 1, 2024 and shall be effective for a six (6) month period ending on July 31, 2024. The parties agree that this agreement will automatically renew in subsequent six (6) month periods upon receipt of payment by OWNER to RESPONSIBLE PARTY unless either party delivers to the other party a NOTICE TO TERMINATE with thirty (30) days notice. This notification must be made in written format and delivered by U.S. Mail to the other party or via electronic mail.
TERMS
A. OWNER will pay the RESPONSIBLE PARTY a fee of two-hundred dollars ($200.00) prior to the beginning of the agreement period as part of this designation. RESPONSIBLE PARTY will visit and document a once weekly required by Panama City Beach Ordinance 1632. There is no requirement that the weekly visit by the Responsible Party include entering the property and risk imposing upon guests in-house. This could simply ensure the registration decal is visible from the exterior and no trash or other violation is present. This fee would also include the time spent by the fire inspector/code enforcement for the first initial or annual inspection. This also would include one monthly visit changing of any air filters, punching drains with a drain snake and a preventative maintenance inspection of toilets and other mechanical systems (this does not include any cost of materials or supplies such as filters, toilet flappers or other items which must be purchased);
B. OWNER will pay RESPONSIBLE PARTY a base fee of $25 for reporting to any REQUIRED additional summons to the property by a government official within one (1 hour) or by the HOA not set out in Paragraph A above. In any case where the matter is resolved within one hour, the Responsible Party will utilize the remaining time to address any other issues within the scope of their knowledge and experience at the Owners' request;
C. OWNER will pay an additional fee of $25 per hour for any event which REQUIRES the RESPONSIBLE PARTY to remain at the property or return to the property within 1 hour for an additional or subsequent event within a 24 hour period upon being summoned by a government official or required by the HOA;
D. OWNER may order/purchase necessary supplies or other items online to be delivered or utilized for necessary repairs from Lowe's in Panama City Beach and designate the RESPONSIBLE PARTY as a person to pick up the items. The bulk of the items must be able to be transported reasonably inside of a standard sized SUV in order to avoid damage from weather or other elements. This service is charged at the same hourly rate of $25 per hour and the OWNER and RESPONSIBLE PARTY will be cognizant of scheduling this within a reasonable time as the property is available. This includes drive time, loading and unloading of items;
This and any guest requests to the OWNER which are accepted by the RESPONSIBLE PARTY are not subject to the 1 hour requirement of being summoned by a government official or HOA; yet if accepted, the Responsible Party will make a diligent effort to do so within a reasonable time frame unless otherwise agreed to by both parties;
E. RESPONSIBLE PARTY shall be permitted to act as a responsible party for other property owners so long as the additional assignment does not interfere with their ability to comply with the requirements listed in Paragraphs A-C above;
F. RESPONSIBLE PARTY is named as "STREAM Advisors" and the owner/operator, shall be the party to address these above items in person. In the event of emergency or otherwise being disposed with a summons to another location simultaneously, the RESPONSIBLE PARTY may further delegate the requirements of Paragraphs A-C to a supernumerary person in order to comply with such summons. The RESPONSIBLE PARTY will be responsible for any compensation paid to the supernumerary person and the OWNER will not incur any additional financial burden than that owed to the RESPONSIBLE PARTY. RESPONSIBLE PARTY will notify the OWNER in any case where the primary person further delegates any of these requirements;
G. RESPONSIBLE PARTY shall ensure that any person acting on behalf of the OWNER has both been background checked and cleared with respect to criminal and sex offender status and does not pose a risk to the owner, property, guests or fellow owners of the property;
H. OWNER authorized the RESPONSIBLE PARTY with authorization to act as their agent for the purposes of facilitating an ejecting/trespass of a guest upon their direction and for the purposes of acting as their designee in order to enlist the assistance of public officials for executing such action;
I. OWNER shall provide or make available to be provided any necessary wristband, parking pass or other access codes/devices in order to carry out the duties above.
J. RESPONSIBLE PARTY shall be responsible for any fines imposed upon OWNER in the event RESPONSIBLE PARTY fails to report to the property within the one (1) hour time frame under Ordinance 1632. RESPONSIBLE PARTY shall NOT be responsible for any underlying violations, however will diligently attempt to abate or perfect any violations to avoid any fines or restrictions being imposed.
K. Any additional fees describe above will be paid by OWNER to RESPONSIBLE PARTY within thirty (30) days of RESPONSIBLE PARTY providing a detailed invoice to OWNER.
L. RESPONSIBLE PARTY is hereby indemnified and immune from any additional responsibilities to the OWNER, to guests or to any third-parties including but not limited to life safety, security, housekeeping, maintenance or injury. OWNER is hereby indemnified and immune from any additional actions of RESPONSIBLE PARTY which fall outside the terms of this agreement.
M. RESPONSIBLE PARTY will make every attempt to coordinate with the following parties in the event a situation is discovered which falls within the duties of the parties listed below:

ACKNOWLEDGEMENT & ACCEPTANCE
The undersigned parties do hereby acknowledge & accept the terms included above. This agreement constitutes a full and complete agreement with jurisdiction of any dispute to be the 14th Judicial Circuit of Florida located in Bay County, Florida.
